OPTA: ‘Number portability must always be possible’

It must always be possible to take one’s telephone number with one to a new mobile operator, even if the end user concerned still has a contract with the provider that he wishes to leave. In addition, the transfer may not take longer than 10 working days, unless the consumer concerned requests a specific subsequent date in writing. Today OPTA amended and published its policy rules entitled Mobile Phone Number Portability [Nummerportabiliteit Mobiele Telefonie] for this purpose.

OPTA has established that insufficient guarantees are still being provided to ensure the smooth implementation of number portability. Consumers have been complaining to OPTA that it has been impossible to take their number with them in a number of cases, for example, during the term of a contract or its term of notice. In addition, OPTA has noted that excessively long periods apply in the case of several providers and that a deposit is requested in specific instances. The amendment of these policy rules makes it clear that such obstacles are not allowed and that it may not take longer than 10 days to complete a transfer, unless the relevant consumer specifies otherwise in writing himself.

As it happens, the fact that callers can take their telephone number with them will not release them from their contract with their former provider. The right to transfer a number has nothing to do with the obligation of consumers to meet their obligation to pay their debts and other contractual obligations.

The new rules will come into effect on 13 April 2003.
